TOA President's Update

You are cordially invited to attend the 2008 Annual Meeting of the Texas Orthopaedic Association, which will be held at the Westin Riverwalk in San Antonio on May 22-24, 2008. The Board of Directors look forward to your attendance and participation in this important educational meeting, and welcome the opportunity to share new

knowledge in the field of orthopaedic surgery with you and fellow orthopaedists from across the state of Texas.

The 2007 TOA Program Committee invites you to submit an abstract if you would like to participate in the scientific session. For your presentation to be considered, please complete the online abstract form and speaker disclosure form. Fax the speaker disclosure form to the TOA office at 866-864-1568. The deadline is Friday, December 14, 2007. You must submit both forms for your presentation to be considered.

These forms can be found on the homepage of the TOA website (www.toa.org) under 2008 TOA Annual Meeting. Note that the proposed length of the paper presentations is five minutes with an additional two minutes for question and answer.

TOA is accredited by the Texas Medical Association’s Continuing Medical Education Committee to provide orthopaedic surgeons throughout Texas the most up-to-date knowledge, trends and techniques in orthopaedic surgery. We will present the 6th annual Resident Quiz Bowl, scientific workshops, practice management information, sports medicine papers and general orthopaedic presentations. Resident awards for best papers range from $1500 to $500 and will be awarded at the TOA Annual Business Luncheon.

TDI To Hold eBill Stakeholder Meeting On Monday, Oct. 22nd
 
  

The Texas Department of Insurance, Division of Workers' Compensation
(TDI) has scheduled an eBill Stakeholder Meeting from 9:30 a.m. to 11:30 a.m. on Monday, October 22, 2007. The meetings will take place at the Division of Workers' Compensation's Central Office, 7551 Metro Center Drive, Suite 100, Austin, Texas in the Tippy Foster Meeting Room 1.107A.  A map to the Division of Workers' Compensation's Central Office can be found here.

This meeting is to discuss issues related to the TDI's eBill companion guide and implementation concerns identified by stakeholders. Specific items to be discussed include:

  • adding flexibility for the Electronic Transmitter Identification Number;

  • adding a Pharmacy NCPDP 5.1 companion guide; and

  • removing or clarifying non-standard segments or instructions.

Insurance carriers and health care providers will be asked for candid feedback on their progress to implement eBill transactional processing, including information on any potential barriers or problems that may impede or delay successful implementation.

TDI will provide conference call services for those stakeholders who cannot attend this meeting in person. The conference call is limited to the first 125 callers and may be accessed by calling: (877) 226-9790 and entering access code 9278155.

2007 Legislative Victories:

  • Prevented debate on any bill that would expand the scope of practice for the podiatrists to work on the ankle.

  • Passed legislation that contained critical adjustments to previous workers’ compensation reforms.
     
    • Doctors performing peer review, utilization review, and retrospective review in workers’ compensation cases must now be licensed in Texas.
    •  Providers of workers’ compensation health care services will not forfeit their right to reimbursement if the claim for payment is filed timely, but erroneously filed with the wrong insurer.
    •  A health care provider reviewing a workers’ compensation case must be certified in a specialty appropriate to the type of care an injured employee is receiving.
     

  • Killed a Senate bill that would have eliminated the standard of willful and wanton negligence in liability claims arising out of emergency care. Had this provision been repealed, the result would have been a roll back of the hard won medical liability reforms.

  • Protected income exemptions for Medicaid, Medicare, CHIP, Worker’s Compensation, TriCare and uncompensated care in the tax bill.

Workers' Compensation: Address Your Pre-auth Concerns Now!
 
  

The state Legislature required the Division of Workers’ Compensation (DWC) to adopt and implement disability management processes. The three components of disability management are:

• Treatment guidelines (ODG) – adopted and implemented

• Return to Work Guidelines (MDA) – adopted and implemented

• Treatment planning requirements - ongoing

As the formal disability management process is being implemented, TMA has identified that there are conflicts between the pre-authorization rules and ODG treatment guidelines. These conflicts give physician offices an opportunity to change the pre-authorization requirements. DWC is accepting comments on pre-authorization now.

As most of you are aware, pre-authorization requirements in the Texas workers’ compensation system adds administrative hassle and burdens to physician offices. The Division of Workers’ Compensation will be changing the pre-authorization requirements. The tool they are using to accept comments is a survey and it can be found here.

This Week In Texas: Mignon McGarry Memos

Robert Scott has been appointed as Texas Education Commissioner.  Scott has served as Interim Commissioner twice before – in 2003 and

beginning in July of this year when Shirley Neely left the post after not being reappointed by Governor Perry.  Scott will serve a term that expires in January of 2011.

Governor Rick Perry has endorsed former New York City mayor Rudy Giuliani for President in the 2008 election.

Kay Bailey Hutchison has announced that she will not run for reelection to the U.S. Senate.  Her current term expires in 2013.  Speculation abounds regarding her future plans and whether she will serve out her current term. 

Rep. Robert Puente (D-San Antonio) has confirmed rumors that he will not seek reelection to his House District 119 seat.  Puente has served in the Texas House since 1991 and currently serves as the Chairman of the House Natural Resources Committee. 

The proposed rules implementing the Texas Franchise tax changes have been published in the Texas Register.  Following the required public comment period, the rules are expected to be adopted in December.  Comptroller Susan Combs estimates that close to 200,000 new entities will have to file franchise reports.
