It’s a very exciting year for
the TOA and it has been a great honor to serve as your
President. I want to personally request your presence and
active participation |

at the 2008
TOA Annual Meeting and Scientific Session to be held on May
22nd – 24th at the Westin Riverwalk Hotel in San Antonio,
Texas.
Omer Ilahi, MD and his team on the Program Committee have
put together an incredible display of educational offerings

Also, you
don’t want to miss the 6th Annual Resident Quiz Bowl. Two
residents from each of Texas’ orthopaedic training programs
will compete for the highly coveted traveling trophy, title,
and bragging rights. Dr. Mark Brinker’s orthopaedic
brain-teasers challenge the contestants and delight
orthopaedists and spouses alike. The 2007 Quiz Bowl Teams
were: Brooke Army, John Peter Smith, UT San Antonio, UT
Houston, William Beaumont and UTMB. The final quiz round
came down to a heated match between UTHSC San Antonio and
Brooke Army Medical Center contestants. Drs. Jason Lowe and
Syed Ahmed of BAMC took home the Quiz Bowl trophy last year.
The TOA exhibit hall will provide you with the opportunity
to explore the market place, compare products first-hand and
plan your purchases of products and services that will allow
you to provide a higher level of care to your patients and
effectively manage your practice.
As always, your association provides complimentary
registration for the annual meeting as one of the many
benefits of TOA membership. All Texas orthopaedic interns,
residents, and fellows are welcome to attend as our guest.

The Board of Councilors of AAOS

Texas Orthopaedic
Association President, John T. Gill, MD, was named Chair of the Board
of Councilors of the American Academy of Orthopaedic Surgeons.

was elected Chair of the Board of |

Councilors (BOC) of the American
Academy of Orthopaedic Surgeons (AAOS) at the organization’s 75th
Annual Meeting, held Mar. 5-9, 2008, at Moscone Center in San
Francisco. He will also serve on the Academy’s Board of Directors.
Active in numerous professional societies, Dr. Gill is currently
president of the Texas Orthopaedic Association, the Texas Orthopaedic
Foundation, and serves in the House of Delegates for both the Texas
Medical Association and the American Medical Association. He is a
diplomate of the American Board of Orthopaedic Surgery and a former
board member of the Dallas County Medical Society. During his year as
the Texas Orthopaedic Association president, Dr. Gill helped launched
the Get Active! Texas public health campaign which is aimed at better
musculoskeletal health and obesity prevention.
Specializing in sports medicine, Dr. Gill is currently an orthopaedic
surgeon in private practice at the Texas Institute for Surgery at
Presbyterian Hospital of Dallas. After earning a medical degree from
the University of Texas Southwestern Medical School, Dr. Gill served
his internship and residency at Parkland Memorial Hospital and
Southwestern Medical School in Dallas. He then completed a fellowship
in sports medicine and surgery of the knee at the Baylor College of
Medicine in Houston.

This Week In Texas:
Third Court of
Appeals Renders Its Opinion
|
|
Third Court
of Appeals Renders its Opinion regarding Texas State Board of
Podiatric Medical Examiners expanding their scope of practice
through rulemaking. The Judges’ Opinion stated: "We
conclude that the board exceeded its authority when it
promulgated the rule and that the rule is invalid."
The case was: Texas Orthopaedic Association, Texas Medical
Association and Andrew M. Kant, M.D., Appellants v. Texas
State Board of Podiatric Medical Examiners; Texas Podiatric
Medical Association; and Bruce A. Scudday, D.P.M., Appellees |

appreciates the court’s careful consideration of this important
issue affecting healthcare for all Texans.
The court’s thorough discussion and
consideration of the issues raised by our challenge to the subject
rule provides helpful guidance for lawful rulemaking by Texas agencies
regulating the practice of all healthcare practitioners in Texas.
To the many TOA members who have
assisted on this issue,,, Thank You! Special appreciation needs to be
offered to several of our members persevering throughout the years to
protect patient safety.

Judges Boot Podiatrists' Foot
Definition
An Austin appeals court sided with Texas Orthopaedic Association
(TOA) and TMA and said the Texas State Board of Podiatric Medical
Examiners was wrong when it adopted a rule that expanded the
definition of the foot to include the bones in the ankle.
"We conclude that the board exceeded its
authority when it promulgated the rule and that the rule is invalid,"
the judges on the Texas Court of Appeals, Third District, said in
upholding medicine's appeal of a lower court ruling. The judges sent
the case back to an Austin state district court that had ruled in
favor of the podiatrists.
The legal battle began in 2000 when the
podiatry board defined the foot as "the tibia and fibula in their
articulation with the talus, and all bones to the toes, inclusive of
all soft tissues (muscles, nerves, vascular structures, tendons,
ligaments and any other anatomical structures) that insert into the
tibia and fibula in their articulation with the talus and all bones to
the toes."
TOA and TMA objected. So did then-Atty.
Gen. John Cornyn when he issued an opinion that said the podiatry
board acted outside its authority. He added that only Texas
Legislature, not an unelected administrative board, can establish or
change the scope of practice for podiatrists, physicians, or any other
health care practitioner.
In August 2005, an Austin district
judge, issued an order in favor of the podiatrists. TOA and TMA
appealed.
"Although there was extensive testimony
and evidence presented during trial showing that treating the ankle
was within the scope of podiatry, no evidence was introduced showing
that treating structures found within the leg were within the scope of
podiatry," the appeals court said in its
March 14 decision.
The court also held that the "rule
authorizes podiatrists to treat parts of the body outside the
traditional scope of podiatry without satisfying the requirements of
the Medical Practice Act. This authorization exceeds the limited
exemption given to podiatrists and would constitute the unauthorized
practice of medicine."
TMA expects anticipate the podiatry board and podiatry association to
ask for a rehearing of the case and, if unsuccessful, appeal to the
Texas Supreme Court.
