TOA President's Update: CME

Keep your eye out for the fall TOA Orthopaedic Connection newsletter.  You will be receiving it next week in the mail.  Some of the featured articles include information on the 2009 Annual Meeting and Socioeconomic Summit, legislative update by Mignon McGarry and information on Maintenance of Certification (MOC) and deadlines.  Part

of the MOC process includes  documenting 120 hours of ACCME-accredited Category 1 CME.  Remember that TOA provides free Category 1 CME and complimentary registration for all meetings as one of the many benefits of TOA membership.  TOA is accredited by the Texas Medical Association to provide  approximately 25 hours of CME to physicians in 2009.

TDI Fines Blue Cross Over Non-Network Claims

State insurance regulators fined Blue Cross and Blue Shield of Texas (BCBSTX) $250,000 and ordered the insurance giant to repay $3.9

million to members for underpaying claims related to treatment in out-of-network hospitals and other medical facilities. Blue Cross denied the allegations but agreed not to contest the Texas Department of Insurance (TDI) findings of fact, a TDI consent order said.

The restitution must be paid over the next several months, said State Insurance Commissioner Mike Geeslin, adding that if the payments do not total at least $3.9 million, BCBSTX must pay the balance to the state as an additional fine.

Blue Cross must notify affected members of the reimbursements by mid-December. In addition, Blue Cross officials have to implement new procedures for paying claims at out-of-network facilities by the middle of August.

"TDI has received complaints that BCBSTX has set its 'allowable' amounts for uncontracted facilities at unreasonable low rates that are less than the amounts billed by the facilities and also less than the rates paid to BCBSTX contracted facilities," the TDI order said. "TDI has alleged that BCBSTX's reimbursement rates are unreasonably low in light of representations made by the company in its advertising and its policies and that the reimbursement rates are so low as to violate Texas insurance laws and regulations."

TDI Deputy Commissioner for Regulatory Affairs Doug Danzier told the Dallas Morning News that the underpayments dated to Jan. 1, 2004, and involved thousands of Blue Cross members in Texas enrolled in PPO plans. He said most of the affected consumers sought care in out-of-network hospitals because of medical emergencies or the services they required were not available in regular network facilities.

Blue Cross did not respond to a request for a comment on the TDI action.

Are you weary of the endless cycle of political ads on your television and radio?  Is it tough to see your way around the campaign signs on

every corner?  Grin and bear it for three more weeks.  Newspapers around the state are busy making endorsements as are many trade associations.  Early voting begins on October 20th and continues until October 31st.  October 28th is the last day to apply for a ballot by mail, an important date for those displaced by Hurricane Ike.
 


October 8, 2008, Wednesday
Gov. Rick Perry has appointed Mary Ann Williamson of Weatherford to the Texas Lottery Commission for a term to expire Feb. 1, 2011. Williamson is a certified public accountant and owner of MKS Natural Gas Company.

Speaker Tom Craddick has created a House Select Committee on Hurricane Ike Storm Devastation to the Texas Gulf Coast. The committee will be charged with reviewing the state and local government response to the hurricane and identifying issues for the legislature to address to prepare for future natural disasters and their aftermath.   Rep. Sylvester Turner (D-Houston) will serve as chairman of the committee and Rep. John Davis (R-Houston) will serve as vice chair. Other members of the committee include Representatives Dennis Bonnen (R-Angleton), Joe Deshotel (D-Beaumont) Harold Dutton (D-Houston), Craig Eiland (D-Galveston), Mike Hamilton (R-Mauriceville), Patricia Harless (R-Spring), Dora Olivo (D-Rosenberg), Debbie Riddle (R-Tomball), Wayne Smith (R-Baytown) and Larry Taylor (R-Friendswood). In addition, there will be one public member, former state Senator A.R. "Babe" Schwartz.

Several trade associations and research organizations have formed the Texas Coalition for a Competitive Workforce (TCCW) in order to focus attention on career and college readiness in public schools.  Coalition members include the Texas Association of Business, the Texas Institute for Education Reform, the Texas Public Policy Foundation, the Governor's Business Council, and the Greater Austin Chamber of Commerce.

The Fifth Court of Appeals in Dallas rejected a lawsuit by Sen. Kim Brimer (R-Fort Worth) that asked the court to remove his Democratic challenger, former Fort Worth City Councilwoman Wendy Davis, from the Nov. 4 ballot.  In its decision, the Court stated that the issue of whether Davis is ineligible to hold office was not reached.  This race may or may not be decided on November 4th.

Gov. Perry Appoints Three to State Board of Podiatric Medical Examiners
 

AUSTIN – Gov. Rick Perry has appointed three members to the State Board of Podiatric Medical Examiners for terms to expire July 10, 2013. The board is responsible for licensing podiatric physicians and regulating podiatric medicine in Texas.

James Michael Lunsford of Katy is a doctor of podiatric medicine in private practice. He is a member of the American, Texas and Harris

County Podiatric Medical associations. He is also a past member of the Texas Podiatric Medical Association and Gulf Coast Podiatric Residency Foundation boards of directors, and is past chairman of the Foundation West Houston Surgical Center governing board. Lunsford received a bachelor's degree from the University of Houston and a doctor of podiatric medicine degree from the Ohio College of Podiatric Medicine. He replaces Matthew Lynch of Troy.

Joe E. Martin Jr. of College Station is senior staff podiatrist for Scott and White Clinic of College Station. He is past president and board member of the Texas Podiatric Medical Association and a member of the American Podiatric Medical Association. Martin received a bachelor's degree from Brigham Young University and a doctor of podiatric medicine degree from the California College of Podiatric Medicine. He replaces Bruce Scudday of El Paso.

James Michael Miller of Aledo is a retired police supervisor for the City of Fort Worth Police Department. He is a past member of the Fort Worth Police Officer Association board of directors, and a member of the National Police Officer Association and Combined Law Enforcement Association of Texas. He is also a public safety supervisor for the Susan G. Komen Race for the Cure. Miller received a bachelor's degree from Texas Christian University. He replaces Carol Baker of Spring.
